Terms of Use

Please read these Terms of Use carefully before using PhotoFieldKit or the photofieldkit.app website. By using our app or website, you agree to be bound by these terms. If you do not agree, do not use our services.
1. License
Subject to your compliance with these Terms, Clarus Multimedia Group grants you a limited, non-exclusive, non-transferable, revocable license to download and use PhotoFieldKit on Apple devices you own or control, solely for your personal or professional photography workflow.
This license does not include the right to sublicense, distribute, sell, or otherwise transfer the app or any rights in it to third parties.
2. Restrictions
You may not:
- Copy, modify, or create derivative works of the app
- Reverse engineer, decompile, or disassemble the app
- Remove or alter any proprietary notices or labels
- Use the app in any way that violates applicable law
- Use the app to infringe on the intellectual property rights of others
3. Intellectual Property
PhotoFieldKit, its name, logo, icons, and all associated content are the property of Clarus Multimedia Group and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.
Your photos and content remain entirely your own. We claim no rights over any images you import, edit, caption, or upload using PhotoFieldKit.
4. Privacy
Your use of PhotoFieldKit is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The app processes all your photos on-device and does not transmit your content to our servers.
5. Third-Party Services
The Upload module allows you to send files to SFTP and FTP servers that you configure. We are not responsible for the security, availability, or practices of those third-party servers. You are responsible for ensuring you have the right to upload content to any server you connect to.
6. No Warranty
PhotoFieldKit is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law, Clarus Multimedia Group disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be error-free, that defects will be corrected, or that the app will be compatible with all devices or operating system versions.
Important for field use: Always maintain a backup of your original files on the memory card until you have verified your imports. We are not responsible for data loss resulting from use of the app.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Clarus Multimedia Group be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of professional opportunities, arising from your use of or inability to use PhotoFieldKit.
Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app.
8. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Connecticut.
9. Changes to These Terms
We may update these Terms as the app evolves. Material changes will be reflected with a new effective date at the top of this page. Continued use of the app after changes constitutes your acceptance of the updated Terms.
